Service Description

1.0 Ethics CE This applied workshop builds on Part 1 to address the documentation demands that arise when records enter legal and adversarial contexts. Participants will develop a note template aligned to their setting and payer requirements, draft medical-necessity language consistent with audit standards, conduct a sample-chart audit, and create a records retention and breach-response protocol. The session then examines responding to records requests, distinguishing subpoenas from court orders, documentation considerations in legally charged matters (divorce, custody, and special-education disputes), and the distinction between the fact witness and expert witness roles. Content is aligned to the BACB Ethics Code for Behavior Analysts (2022). Learning objectives Upon completion, participants will be able to: 1. Identify the components of a defensible client record and apply retention requirements across state, board, and funder standards. 2. Describe the appropriate response to records requests, subpoenas, and court orders. 3. Differentiate the fact witness and expert witness roles and their respective documentation obligations.
